We are recruiting for In-house Healthcare Attorney for a Global Healthcare Company. The company's services include primary care, urgent care, nutrition, lab, diagnostic, health care education and resources for patients.

Position Summary

Provide broad-based counsel to support the healthcare law.

Minimum of 7 years of HEALTHCARE LEGAL EXPERIENCE is required. This position is located in the company's US headquarters in Miami, Florida.

Essential Job Functions

· Responsible for providing transactional and general legal support to the commercial, development, clinical and medical affairs areas.

· Interact with key company leaders, government agencies, law firms, trade organizations and other external agencies.

· Review and provide oversight on a variety of commercial, clinical, and operational contracts.

· Be an informed and accessible resource regarding new laws, regulations and industry trends affecting the company and the healthcare provider sector.

· Identify business and legal risks and work with the business to provide solutions which balance legal issues and business objectives.

· Provide support to legal due diligence in connection with healthcare M&A activities.

· Collaborate with compliance staff to facilitate compliance related investigations.

· Provide general commercial and contract support across all lines of business (Medicare Advantage, behavioral health, institutional pharmacy, home health, hospice, and nurse practitioner services, palliative care).

· Review, draft, and negotiate health care and health insurance related agreements and contracts; including but, not limited to, network provider agreements, payor agreements, business associate agreements, nondisclosure agreements, consulting agreements, and data use and transfer agreements.

· Manage relationships with outside counsel on various projects, including litigation.

· Support build out of legal affairs policy, process, and recordkeeping.

· Partner with the Information Security team to address legal considerations for HIPAA security rules and data security generally.

· Provide legal support to Compliance relating to policies, trainings, corrective actions and applicable federal/state transparency reporting.

Required Education and Experience

· JD degree from a nationally recognized ABA approved law school, admission to the bar in at least one state, registered/eligible for Florida in-house counsel.

· Minimum of 7 years of legal experience with a healthcare-related law firm, regulatory agency, or a life sciences or pharmaceutical company counseling on legal issues relating to advertising and promotion, scientific exchange, patient support programs, interactions with healthcare professionals, reimbursement, and privacy.

· Attorney should possess knowledge and experience working with laws and regulations relating to FDA advertising and promotional regulations, the Anti-Kickback Statue, Stark Law, the False Claims Act, HIPAA, Medicare Advantage, OIG Guidance, health care services reimbursement and value-based contracts, share saving agreements and related topics.

· Excellent verbal and written communication skills, including the ability to communicate substantive legal advice and actionable risk assessment.

· Contract drafting and negotiation skills.

· Outstanding interpersonal and organizational skills to manage a fast-paced workload entrepreneurial environment and complete multiple projects in a timely manner.

· Strong team orientation, great attitude and adaptability.

· Ability to deal with a broad range of legal and business matters.

· Ability to work both independently and collaboratively.

· Ability to work in a multicultural and fast paced company.

Job Type: Full-time

Pay: $175,000.00 - $180,000.00 per year
